Welcome to Suhani Mara. These Terms of Service ("Terms") govern your use of our website and any enquiries, purchases, commissions or other transactions made through or in connection with Suhani Mara.

By accessing or using this website, submitting an enquiry, placing an order or commissioning a bespoke piece, you agree to these Terms. Please read them carefully.

For purposes of these Terms, "Suhani Mara", "we", "us" and "our" refer to Suhani Mara and its business operations in Kenya.

1. About Suhani Mara

Suhani Mara creates jewellery, accessories and bespoke pieces designed and handcrafted in Kenya using materials sourced from Kenya and around the world.

Our collections may include gemstones, precious metals, antique silver, historical coins, beads, fossils, meteorites, eggshell, shell, wood, leather, pearls and other natural, historical or handcrafted materials.

Some pieces are available for immediate purchase, while others may be made to order, one of a kind, available by enquiry, or created as bespoke commissions.

2. Use of This Website

You may use this website for lawful personal and commercial enquiries relating to Suhani Mara.

You must not:

• use the website for any unlawful, fraudulent or harmful purpose;
• attempt to interfere with the security or operation of the website;
• copy, reproduce or commercially exploit our photographs, designs, text, branding or other content without permission;
• submit false or misleading information; or
• use automated tools to scrape, reproduce or extract substantial portions of the website without our permission.

We reserve the right to restrict access to the website where we reasonably believe it is being misused.

3. Product Information

We take reasonable care to describe and photograph our pieces accurately.

However, many Suhani Mara pieces are handcrafted and incorporate natural, antique, recycled, historical or individually sourced materials. Variations in colour, texture, markings, shape, patina, dimensions and finish may therefore occur.

Such natural or handcrafted variations are part of the character of the piece and are not necessarily defects.

Colours may also appear slightly different depending on your screen or device.

Where a particular characteristic is important to you, please contact us before ordering.

Nothing in this section limits your rights where a product is defective, materially different from its description or otherwise does not meet requirements imposed by applicable Kenyan law.

4. One-of-a-Kind and Limited Pieces

Certain Suhani Mara pieces are unique or made using materials that cannot be replicated exactly.

Adding a product to a cart, wishlist or enquiry does not reserve it unless we expressly confirm the reservation.

If a one-of-a-kind product becomes unavailable after an order has been submitted, we will contact you and, where payment has already been received, offer an appropriate alternative or refund the amount paid for the unavailable item.

5. Orders and Acceptance

An order or enquiry submitted through the website does not automatically mean that we have accepted it.

An order becomes binding once we have accepted the order or commission and, where applicable, received the required payment or deposit.

We may decline or cancel an order where, for example:

• the item is no longer available;
• there has been an obvious pricing or product-description error;
• payment cannot be authorised;
• we are unable to fulfil the requested bespoke specifications;
• delivery to the requested destination is unavailable; or
• we reasonably suspect fraudulent or unlawful activity.

If we cancel an order after receiving payment, we will refund the relevant amount unless we are legally entitled to retain part of it for work already authorised and performed.

6. Prices

Prices are displayed in the currency shown on the website and may be changed from time to time.

For bespoke, customised, made-to-order or gemstone-dependent pieces, the price may be provided through a separate quotation.

A quotation may depend on factors including:

• materials and gemstones selected;
• precious-metal prices;
• design complexity;
• availability and rarity of materials;
• craftsmanship required;
• alterations requested;
• delivery requirements; and
• the agreed production timeline.

Once a bespoke quotation has been accepted and the required deposit paid, any subsequent changes requested by the customer may result in additional charges. We will communicate these before proceeding with the additional work.

7. Bespoke and Custom Orders

Bespoke work at Suhani Mara begins with a conversation and may involve design development, material selection, gemstone sourcing, heirloom redesign, resizing or other customisation.

Before production begins, we may agree with you on matters such as:

• the design direction;
• materials and gemstones;
• estimated price;
• deposit;
• estimated completion timeframe; and
• any significant customer-specific requirements.

Because bespoke and personalised pieces are created specifically for you, cancellation or significant design changes may not be possible once materials have been specially sourced or production has begun.

Where cancellation is accepted, we may deduct reasonable costs already incurred, including design work, specially sourced materials and work completed.

This does not affect any rights you may have under Kenyan law where a product is defective, materially misdescribed or otherwise fails to comply with applicable legal requirements.

8. Heirloom and Customer-Supplied Materials

Where you provide jewellery, gemstones, metals, coins, heirlooms or other materials for incorporation, repair or redesign, you confirm that you have the legal right to provide those materials to us.

We will take reasonable care of customer-supplied materials while they are in our possession.

Because older jewellery and materials may have hidden weaknesses, previous repairs, wear, fractures or other conditions that are not apparent before work begins, we will inform you where we identify a material issue that may materially affect the agreed work.

Where appropriate, additional work will only be undertaken after consultation with you.

9. Payments

Payment may be accepted through the methods displayed or agreed at the time of purchase.

Payments may be processed by third-party payment providers. Their own terms, security procedures and privacy practices may apply to payment processing.

You agree to provide accurate billing and payment information and confirm that you are authorised to use the selected payment method.

For bespoke or made-to-order work, a deposit may be required before sourcing or production begins, with the balance payable according to the agreed quotation or invoice.

10. Shipping and Delivery

Delivery times shown on the website or communicated to you are estimates unless we expressly agree otherwise.

Handcrafted, made-to-order and bespoke work may require additional production time.

Shipping charges and available delivery methods will be communicated during checkout or before an order is confirmed.

For international orders, the customer may be responsible for customs duties, import taxes, clearance charges or other fees imposed by the destination country unless expressly stated otherwise.

11. Returns, Exchanges and Refunds

Returns, exchanges and refunds are governed by our Returns & Refund Policy and applicable Kenyan law.

Different conditions may apply to:

• ready-made pieces;
• made-to-order pieces;
• bespoke or personalised pieces;
• resized or altered pieces;
• earrings or other products subject to hygiene considerations; and
• damaged, defective or incorrectly supplied products.

Nothing in these Terms or our Returns & Refund Policy excludes or limits any mandatory rights or remedies available to consumers under applicable Kenyan law.

12. Jewellery Care

Jewellery may naturally change with wear and over time.

Silver may oxidise or develop a patina. Natural materials, gemstones, eggshell, leather, wood, antique components and other materials may react differently to moisture, chemicals, perfume, cosmetics, heat, impact or prolonged exposure to sunlight.

Customers are responsible for following reasonable care instructions supplied with a product or published in our Jewellery Care guide.

Normal wear and tear, accidental damage, inappropriate storage or damage caused by failure to follow care instructions is not regarded as a manufacturing defect.

13. Intellectual Property

All intellectual property associated with Suhani Mara, including our brand name, logos, trademarks, jewellery designs, photographs, illustrations, graphics, text, collection names, website design and other original material, belongs to Suhani Mara or is used by us with permission.

Some Suhani Mara designs may also incorporate protected brand marks or other identifying elements.

You may view and share links to our website for personal, non-commercial purposes.

You may not reproduce, manufacture, copy, modify, distribute, sell or commercially exploit our designs or website content without our prior written permission.

14. Third-Party Services and Links

Our website may contain links to or integrations with third-party services, including payment providers, delivery providers, social media platforms, Shopify applications or other websites.

We are not responsible for the content, availability or independent practices of third-party websites or services that we do not control.

Your use of such services may also be subject to their own terms and privacy policies.

15. Privacy and Personal Information

We collect and use personal information in connection with enquiries, orders, payments, delivery, customer service and other interactions with Suhani Mara.

Personal information is handled in accordance with applicable Kenyan data-protection requirements, including the Data Protection Act, 2019, where applicable.

16. Website Availability

We aim to keep the website accurate, secure and available but cannot guarantee uninterrupted or error-free access.

We may update, modify, suspend or withdraw parts of the website where reasonably necessary, including for maintenance, security, inventory updates or improvements.

17. Liability

Nothing in these Terms excludes or limits any liability or consumer right that cannot lawfully be excluded or limited under Kenyan law.

To the extent permitted by law, Suhani Mara will not be liable for indirect or consequential losses arising solely from the use or inability to use this website.

Our responsibility for products purchased from us remains subject to applicable consumer protection and sale-of-goods laws.

18. Changes to These Terms

We may update these Terms from time to time to reflect changes in our business, website, services or applicable law.

The latest version will be published on this page together with the date it was last updated.

Changes will apply prospectively and will not alter an order or bespoke commission already accepted unless the parties agree otherwise or the law requires it.

19. Severability

If any part of these Terms is found to be invalid, unlawful or unenforceable, that provision will be interpreted or limited to the extent necessary, and the remaining provisions will continue to apply.

20. Governing Law and Disputes

These Terms and transactions with Suhani Mara are governed by the laws of the Republic of Kenya.

If a concern or dispute arises, we encourage you to contact us first so that we can try to resolve the matter directly and fairly.

Where a dispute cannot be resolved amicably, it may be referred to the courts or other competent dispute-resolution mechanisms available under Kenyan law.

Nothing in this section limits any statutory right available to a consumer.
